Dear Sir Wildlife and Countryside Act 1981 Section 53 and Schedule 14. Appeal by Kessingland Parish Council Claimed Byway Open To All Traffic at FP15 Kessingland.
1. The Secretary of state for Environment Food and Rural affairs has considered the appeal under paragraph 4 subsection 1 of Schedule 14 of the Wildlife and Countryside Act 1981 made by Kessingland Parish Council on 20 October 2003 against your authoritys decision not to make an order modifying the definitive map and statement of public rights of way for the area showing Beaconsfield Road/Footpath 15 as a Byway Open to all Traffic from its junction with Wash lane to its junction with Green Lane Kessingland.
2. The Secretary of State having considered the appeal considers that an order should be made. A copy of the decision letter to Kessingland Parish Council is attached.
3. Accordingly the Secretary of State under the powers contained in paragraph 4 subsection 2 of Schedule 14 to the Wildlife and Countryside Act 1981 and al other powers enabling her in that behalf hereby directs Suffolk County Council to make an Order under Section 53 subsection 2 and of Schedule 15 to the 1981 Act to modify the definitive map and statement for the area so as to show that part of the appeal route from the junction of FP 15 with Beaconsfield Road to the junction of Beaconsfield Road with green Lane [described as being between points B and C in the Inspectors report] as a Byway Open to all Traffic as proposed in part in the application dated 14 February 1994.
