WILDLIFE & COUNTRYSIDE ACT 1981 MODIFICATION OF DEFINITIVE MAP AND STATEMENT SUFFOLK COUNTY COUNCIL (PARISH OF KESSINGLAND) MODIFICATION ORDER 2005 Dear Madam Thank you for your letter dated 20 July 2005 regarding the above mentioned Order that has not yet been submitted to the Secretary of State for determination. According to paragraph 7(2A) of Schedule 15 to the Wildlife and Countryside Act 1981, the Secretary of State does not have to hold an inquiry or a hearing if, in his opinion, none of the representations or objections received relate to an issue which the Inspector is able to consider. Where this is the case, the Inspector will make a decision based on the papers submitted by the Order Making Authority. When the Order is submitted, the objections will be examined to see if they are relevant. As part of our procedures, any such objector will be invited to modify their objections if they are able to do so. If none can raise any issues that can be taken into account, the Order will be submitted directly to an Inspector.
