Modification of Definitive Map and Statement

Suffolk County Council (Parish of Kessingland) Modification Order 2005.

I enclose a notice of a Modification Order, together with a copy of the Order upgrading part of FP15 Kessingland to a byway open to all traffic. The Order as originally served on you in April this year, but due to a technical problem, it is considered that the Order needs to be re-advertised in the press and on site; the Order itself has not been altered. I also enclose an explanatory statement. This explains which documents (if any) were taken into account in preparing the Modification Order. If any of these documents are not in the County Councils possession you are entitled to any information that the County Council has as to where the documents may be inspected. I should like to explain that all claims have to be considered on the basis of evidence only. This may be documentary evidence such as Tithe Maps or Inclosure Awards, or it may be user evidence. The legislation does not permit the County Council to take into account factors such as suitability of the route for a specific purpose, or the effect on the environment. It is important that any representation or objection that you wish to make with regard to the enclosed Order is made by the date specified in the enclosed notice of modification. Please note that any representations made prior to making of this Order must be re-submitted as formal objection, but it is not necessary to re-submit any objection already made during the previously advertised objection period. Please bear in mind that such correspondence cannot be treated as confidential and may be inspected by any interested party.  Yours sincerely Sandra SidoliLegal Assistant/Researcher
