MINUTES of a PLANNING & TRANSPORTATION COMMITTEE Meeting held on THURSDAY 15th MARCH 2007 at 7.00pm in the Guildhall, Butchers Row, Barnstaple

PRESENT: Councillor Mrs Eastaugh (Chairman)

Councillors: S P Upcott, F B Vernon, S P Harvey, Mrs S Haywood, and Miss C Upcott

PT272 APOLOGIES

As recorded on the attendance sheet apologies were received from Councillors Mrs Preston, J Preston, R Knight, J Phillips and Mrs Hunt.

PT273 DECLARATIONS OF INTEREST

The following declarations of interest had been entered on the reverse of the attendance sheet: -

Cllr S P Upcott Item No. 43977 Personal as a family member works in the same industry.

Cllr Mrs S Haywood Item No. 43932 Personal and Prejudicial as the applicants are acquaintances and they carry out electrical work for them.


PT274 MINUTES

RESOLVED that the minutes of the meeting held on the 1st March 2007 be approved as a correct record and signed by the Chairman.

PT275 DEPOSITED PLANS

a) 43929 Change of use class C3 (residential) to use classes C1 (hotels) and C2 (residential institutions) together with extension to form additional staff accommodation, Elmfield, Bear Street, Barnstaple
Applicant: The Bethany Project

Recommends Refusal as: -
The Committee felt that this is an inappropriate place for this facility
This is already a very congested area and this project would increase the traffic in this area
The project would also be in close proximity to the school and the Committee are concerned, as they do not know the kind of residents that will be staying here.

If the North Devon District Council is mindful to approve this application then the Committee would like reassurance of the residents that will be staying here. The surrounding residents will need to be made aware of the facility and the Committee would like a site inspection.

Recommends Approval subject to no adverse comments from the neighbours.

e) 44020 Application for consent to carry out work to trees covered by a Tree Preservation Order to remove Ash Tree, 20 Rumsam Gardens, Barnstaple
Applicant: Mr Rudd

Recommends Refusal as: -

There is not a report from a qualified Tree Surgeon
The works to be carried out are for cosmetic reasons and not because the tree is diseased or dead.

PT276 POSSIBLE PLANNING INFRINGEMENTS, HIGHWAY CONCERNS AND MOBILE LENGTHSMAN REPORTS

Councillor S P Harvey submitted the following report:

Residents have reported that the van is being parked on the pavement, photograph enclosed, outside Grattons Butchers. Boutport Street, Barnstaple

Councillor Miss C Upcott submitted the following complaint: -

The potholes that were reported at the last meeting have been filled in but in a very poor condition and they will not last long, Heppenstall Road, Barnstaple.

RESOLVED that the Committee Clerk forward these complaints to the relevant authority.

PT277 DECISION NOTICES

The following Decision Notices were received: -

PT279 WINDSOR ROAD

The Committee received correspondence from the Windsor Road Residents Group regarding the trees in Windsor Road and the wildlife area/corridor at Scotts Moor.

The Committee felt that the landowner has complied with the law as far as the trees are concerned but improved streetlights possibly with longer arms so the light shines further for the area could be looked into.

RESOLVED

That the Committee Clerk writes to Councillor B Greenslade and request if improved streetlights can be installed in this area.
That the information be received and noted.

PT280 STOPPING UP OF HIGHWAY

The Committee received a notice of stopping up of an area of highway (verge) adjacent to and between A39 Atlantic Highway and 22 Fallow Fields (Nr Landkey Road), Barnstaple, Devon.

PT281 EDUCATION CONTRIBUTIONS CODE OF PRACTICE

The Committee received notice that the North Devon District Council has now adopted the Education Contributions Code of Practice as a Supplementary Planning Document within the Local Development Framework for North Devon.

PT282 DEVON RURAL TRANSPORT PARTNERSHIP

The Committee received the Devon Rural Transport Partnership Winter Newsletter for 2007.
