Southwater Parish Boundary Map

Bruce Milton, who is responsible for mapping in the Planning Department at Horsham District Council, has spoken to the Clerk in relation to an error that was made in establishing the parish boundary to the south of the village.

Mr Milton has sent a new map showing the correct boundary, which now means that the properties known as Woodfords and Little Woodfords are now in the parish of Shipley.

Bruce Milton has also sent a map of the location and numbers of TPOs in the parish of Southwater. A copy of this map has been passed to Mr Denis Bull as the Parish Tree Warden.

Mr Tony Bull said that some oaks had been felled in Denne Park in the area covered under TPO No 1. He had informed the Clerk, and asked the Deputy Clerk if she had any further information. The Deputy Clerk said that she would investigate the matter.

Horsham District Council Draft of New Procedures for Planning Obligations

Councillors will have received a copy of this document, which was discussed at the last District Clerks? meeting on 17th May.

A Government Circular on Planning Obligations issued in November 2004, sets out proposals for streamlining the negotiated route for planning obligations and introduces Optional Planning Charges or OPGs, and the ideal of linking planning gain supplements or PGSs with the granting of planning permissions.

The District Council is looking to develop model Section 106 agreements for Planning Obligations to improve the speed and efficiency of the preparation of legal agreements.

One innovation will be the creation of a Communities Facilities Fund, which will comprise of the contributions made by developers towards unspecified community facilities. Applications may be made for allocations from this fund which can go towards community projects.

However, the point was made at the District Clerks? meeting that applications may be made by any community organisation, and Parish Councils may miss out on funding as a result.

Mr Senneck said that the Parish Council should object to the proposal to make development monies available to all. He said that in his opinion, such monies should stay within the village or in the immediate locality of the development to which they pertained. He was also of the view that Parish Councils should be the first approached when monies were available for distribution.

Mr Clarke agreed, and asked the Deputy Clerk to remind the District Council that the Chief Executive has previously agreed that Southwater should be consulted on any Section 106 agreements within the parish, prior to their being finalised.

It was agreed that the Deputy Clerk should pass these views on the draft proposals onto the District Council.

Mr Senneck asked the Deputy Clerk to find out the latest situation with the remaining s106 monies from the RSPCA.

Notification of Tree Preservation Order, letter dated 13th May 2005

On 10th May, the District Council confirmed TPO 1250 in relation to trees to the front of Nos 1-8, Shipley Rd.

Southern Water ? Water Resources Situation, letter dated 26th May

Southern Water have written to advise that the recent low rainfall has left water resources well below average for the time of year, and that hosepipe and sprinkler restrictions are shortly to come into force in the Sussex area.

Since this letter was received, a hosepipe and sprinkler ban has now been imposed on the district.

Earl of Lytton, letters dated 17th May and 31st May ? Rose Cottage

John Lytton has written to enclose his final account for consultation work in relation to Rose Cottage.

As this matter is now closed, Rose Cottage will not longer appear on future agendas.

The Earl of Lytton also congratulated the Council on receiving Quality Council Status.

Horsham District Council, letter dated 1st June 2005

Will Jones, the District Arboriculturist, has written in response to the Parish Council?s request to place Tree Preservation Orders on trees at Woodpeckers and land to the rear of St Helier and Roselyn in Southwater St.

Mr Jones states that in his view there are a number of trees on the rear boundary worthy of retention, though none of outstanding or special merit. However, these trees are to be retained under the current development plans for the site, and are a suitable and satisfactory distance away from the closest proposed dwelling.

However, there are also a number of smaller garden trees within the site, and while some have a degree of merit, none appears to satisfy the normal criteria for protection by a TPO. Therefore, it is inexpedient and inappropriate for the District Council to place TPOs on any of the trees within the site.

Request for Training in Planning Matters

At the request of the Parish Council, the Clerk enquired about the possibility of the District Council running another planning training seminar for Parish Councillors.

Ray Wright, Head of Development Control, has replied that he has received other such requests from other Parish Councils and that a training session will be organised in the near future. Items which could be covered included recent changes in the use classes order, the encouragement of use of "untidy land" notices, and the new Planning Obligations proposals. He will advise the date when it is arranged.

Mrs Hill said that it might be best to write to Mr Wright now to express an interest in such a course, as on a previous occasion, spaces on a similar course filled very quickly.

Mrs Flores-Moore said that the Parish Councils should be aware that the Government are now actively encouraging the inclusion of social-housing in new developments.

Arden, correspondence dating back to October 2004

Ray Wright, Head of Development Control has advised that all correspondence relating to the cladding on the two houses built on the site of the house Arden on Worthing Rd has been passed to Val Cheesman, the officer responsible for the original application.

P37/06/05 VILLAGE CENTRE REDEVELOPMENT

The Deputy Clerk showed Councillors some artist?s impressions of how the new centre will look. These will be put on display in the Council Chamber.

Further to the recent steering group meeting it was reported that the site is progressing well. An amended plan for the Community building has been lodged with the Planning Department, and should be issued by the end of June.

The possibility had been discussed that the blocks be named after other authors to link with the Lintott theme. However, Mr Senneck has insisted that the field names supplied by the Parish Council be used, including Fairbank Rd for the new road.

The police are not happy with the size of the accommodation offered to them in the community building, and they would prefer a reception area on the ground floor. It has been suggested that the police area be combined with the area allocated for a District Council officer, with the officer being accommodated with a "hot desk" within the Parish Council Office. Messages could be taken at the Parish Council reception desk for both the District Council Officer and the Police Office. This proposal was agreed at last night?s Finance and General Purpose Committee.

Mr Bull asked if there would be signage for the police office outside the building, so that the public would know that it is there. Mr Senneck said there would be signage in the main hallway of the building.

It is intended that there will be sculpture within the courtyard of the shopping area, possibly of an iguanodon on a Southwater brick plinth.

Planning permission was granted for the pub/restaurant, with Smith & Western being the intended tenants.

It was reported that all the retail shops have been let or were under discussions with the proposed tenants. Tenants include a bank with cash point, a post office, a Chinese/Fish and Chip shop and other food retailers.

Mr Bull asked if the bank would have the same opening hours as at present. Mr Senneck thought that it would, but there would be a cash point.

Mr Bull then asked if there were planning conditions in place to keep the shop units as retail units, so that they could not become something else in the future. Mr Senneck said that the District Council was the landlords, and that such planning conditions were in place, but reminded Mr Bull that planning conditions can be changed by future planning applications.

P38/06/05 PUBLIC OPEN SPACE

Blakes Farm Road Area

Nyes Lane

A resident of Nyes Lane contacted the Clerk with concerns that some properties in the area intend to create access gates from their gardens into the open space. The Clerk informed the resident that such accesses would not be permitted, as this would create a pathway which would spoil the established woodland.

Turners Close

Residents of Turners Close attended the Finance and General Purpose Committee last night, and it was agreed that the gap in the fence should remain, but the Parish Council are investigating the possibility of installing a kissing gate.

Mr Bull said that he had been present at the meeting, and he thought that Mr Senneck and the Clerk had been entirely correct in their assessment of the health and safety issues regarding the fence.

Mr Senneck reported that he and the Clerk had been on the site that afternoon to meet with a contractor with a view to providing an estimate for the kissing gate.

Nutham Lane/Eversfield

Nothing to report.

Church Lane Play area

The litter bin in the play area has been vandalised beyond repair. However, the District Council have offered a second hand bin free of charge, which the Clerk has accepted with thanks.

Ben?s Field, Southwater Country Park

Reports of the path in the bridge area being very slippery with mud have been passed onto Steve Delahunt at the Country Park. He has replied that the mud was caused by works to the bridge and will dry up, but the path will be resurfaced in July.

The gap from Old Stakers Lane will be blocked off temporarily to stop any incursions, and work will be completed this summer to provide entrance onto the cycle route from both New and Old Stakers Lane for pedestrians and cyclists, while preventing motorcyclists and other vehicles accessing Ben?s Field and the Quarry. The cycle route will run through the Millennium Wood, across the bridge and to the north of the Quarry Lake to Old Stakers Lane.

 

P39/06/05 PUBLIC PARTICIPATION

It was proposed by Mr Clarke and seconded by Mrs Flores-Moore that Standing Orders should be suspended in to order to allow members of the public to speak. All agreed.

 

There being no points that councillors wished to make, Standing Orders were reinstated.

P40/06/05 HIGHWAYS, DRAINAGE, STREET LIGHTING, FOOTPATHS AND

RIGHTS OF WAY

Charge for Speed Indicator Device

West Sussex County Council have written to advise that there will now be a charge of £50 for a half day siting of a SID or Speed Indicator Device, following a request by a Parish Council or a member of the public.

Southern Cranes Enquiry

Ray Wright, Head of Development Control, has written in response to the Clerk?s query as to why the District Council was not present at the recent enquiry into the Operators Licence for Southern Cranes.

Mr Wright states that the District Council were not notified of the second enquiry. The Council objected on environmental grounds at the first enquiry. The Traffic Commissioner held the second enquiry to receive further information from County Highways. However, the County Surveyor did not attend either enquiry and raised no objections to the licence.

Mr Wright says that the District Council would have had difficulty in sustaining a highways objection which it did not present in the first instance, and that he is disappointed that the District Council does not seem to get any support from the County Surveyor in these matters.

Mrs Hill, who had attended the enquiry, reported that the Traffic Commissioner?s Clerk had told her that she had been in touch with Horsham District Council, and that they had declined to attend. However, Mrs Hill did not know which department of the Council had been contacted, and it may have been that the Planning Department were not, in fact notified.

Stopping Order in Cripplegate Lane

The Government Office for the South-East has written to advise of a stopping order in Cripplegate Lane at the junction with Wealdon Close in order to allow the owners to erect a fence permitted under appeal under SQ/114/03. The date the road will be stopped is yet to be advised.

It was agreed that there was no objection to the order.

Change in Bus Services

As a result of the retendering of County Council bus services there will be a change to the number 23 service from Horsham to Southwater. Whilst the Monday to Saturday service will remain the same, the Sunday service will be changed from Stagecoach to Compass Travel with minor unspecified changes to the timetable.

Pedestrian Signage via the Green Lane

The Clerk wrote to Neil Smith, County Highways Manager to enquire into the possibility of signage directing pedestrians along Footpath 1668, the Green Lane off Southwater St. This would enable a safe crossing of the A24, and was in response to a local resident requesting a footbridge at Hop Oast.

Mr Smith has looked into the matter, and in his opinion, this route represents a considerable diversion to pedestrians. Green Lane is unmetalled and passes along a narrow lane with no pavement along some of its length, and Mr Smith cannot support the proposal.

He has however, passed the letter onto Public Rights of Way.
