MINUTES OF A MEETING OF STAPELEY & DISTRICT PARISH COUNCIL

HELD ON 19TH JULY 2006 AT BROAD LANE METHODIST CHAPEL

1          DECLARATIONS OF INTEREST

 

Councillors S McEneny and S Heathcote declared personal interests in agenda item 7 (Cronkinson Development) on the basis that they lived in houses built by Bovis Homes. 

No other Member made any declaration of interest in any item of business on the agenda.

 

2          MINUTES     

 

            RESOLVED:  That the minutes of the meeting held on 21st June 2006 be approved as a correct record subject to the deletion of the name "Councillor S McEneny" in the list of those present.

 

3          PUBLIC QUESTION TIME

 

3.1       At the previous meeting, the Parish Council agreed that a facility for members of the public to ask questions should be incorporated into the Parish Council's Standing Orders.   The Parish Council was invited to ratify the agreement, and to include the provision in Standing Order No. 15, as paragraphs 15a and 15b.

            RESOLVED:  That the Parish Council's Standing Orders be amended, as attached to these minutes, to reflect the inclusion of a public question time procedure to be included in Standing Order No. 15 (paragraphs 15a and 15b) to allow members of the public to ask questions at the commencement and conclusion of each Parish Council meeting.

            3.2       Public Question Time

In accordance with the Parish Council's Standing Orders (as amended) a member of the public asked a question, following which it was agreed that dates of future litter-picks be advertised on the notice-board.

4          CRONKINSON DEVELOPMENT

4.1       The Parish Council received, for information, a progress report from the Borough Council's Legal Department, in respect of the Community Hall and the public open space.

4.2       Mr Hyldon and Mr Milner (Bovis Homes) were in attendance for this item, and up-dated the Parish Council on the following matters -

-                      Area D - newts situation

-                      Start date/completion date of Community Hall:  Number of issues to be clarified with Crewe & Nantwich Borough Council.  Mr. Hyldon would verify and report back to the parish Council.

-                      General clearing of the area.

-                      Public open space - expected to be completed by December.

-                      Tree survey

-                      Nature reserve

-                      Flooding in vicinity of Hawksey Drive

-                      Landscaping plans to be submitted to the parish Council.

-                      Project Plan.  AGREED:  That a copy of the project plan be provided for display on the parish council notice-board.

Members of the Parish Council were able to ask questions and these were responded to by Mr Hyldon and Mr Milner, as appropriate.

4.3       Public Question Time

A member of the public asked a question and this was responded to by the Bovis Homes representatives.

           

5          CORRESPONDENCE

           

            The Clerk reported on items of correspondence.

6          "NANTWICH NOW"

It was reported that    the Project Manager for "Nantwich Now" had requested the opportunity to attend the meeting to outline the "Nantwich Now" scheme.  However, subsequent to that request, she had notified the Clerk that the way in which the project was publicised had been revised and would not be in attendance.  She had undertaken to keep the Parish Council apprised of progress on the project.

7          PARISH PLAN

At the previous meeting, Councillor Wilcock had been given a "steer" by the Parish Council to consult with local residents who had expressed an interest in becoming members of the Parish Plan Steering Group. 

Councillor Wilcock outlined progress on contacts made with a number of local people who had expressed interest in the Parish Plan process.  August was a holiday month and he reported that he did not propose taking any further action until the end of August.

8          YOUTH ISSUES

It was reported that John Bailey (Cheshire County Council Youth Service) had contacted the Clerk about facilities within the parish for young people.  He would be in attendance at the August meeting to outline proposals and opportunities which the Parish Council may wish to consider.

           

9          FINANCIAL MATTERS

9.1       Authorisation of Payments

RESOLVED:  That the following payment be authorised.

£40.00            Cheshire Association of Local Councils:              

                        Fee for Basic Induction attended by Councillors Heathcote and

                        Johnson.

9.2       Budget Proposals - 2007/2008

As agreed at the previous meeting, the first draft of the budget proposals for 2007/2008 was submitted.

Members gave initial consideration to the document. 

RESOLVED:  That the document, together with changes discussed at the meeting, be submitted to the September meeting for further consideration.

10.3         Receipts and Payments - 30th June 2006

RESOLVED: That the indicative Receipts and Payments statement for the period 1st April 2006 to 30th June 2006 be approved. 

10        PARISH NEWSLETTER

            The Parish Council was invited to give consideration to articles for inclusion   in the   next parish newsletter. 

During discussion of this item, Members were invited to consider adopting a "specialist" approach with individual parish councillors taking on responsibility for specific areas of work; for example, highways matters, website etc.  It was further suggested that the website could include a section entitled "Get to Know Your Parish Councillors".  Following a full discussion, there was a general consensus that there should be no change to current roles, and that groups of Members continue to work informally on projects in which they had a particular interest.

Councillor McEneny undertook to edit the next edition of the newsletter.

12        PLANNING MATTERS

12.1         Planning Applications

P06/0709       Stapeley House, Wybunbury Lane : Conservatory

RESOLVED:  that no objection be raised to the application.

P06/0758       Conversion of out-building to residential annexe - "Eversley"

                        Second Dig Lane.

At this point in the meeting, Councillor M Wilcock declared a personal and prejudicial interest in the application on the basis of his friendship with the applicant; he withdrew from the meeting during consideration of the application and voting.

            RESOLVED:  that no objection be raised to the application.

            Note:  Councillor Wilcock re-joined the meeting.

            12.2    Planning Schedule

The Parish Council received for information up-dated planning schedule.

13        COUNCILLORS' REPORTS

 

(a)        Parish Councillors raised the following issues and the Clerk was asked to make enquiries/take action as appropriate -

 

§                    New planning legislation likely to come into force in 2007

§                    Petition raised by residents of London Road had been referred to the Speed Limit Review Panel

§                    Dog-fouling (cul-de-sac end of London Road) - possible item for the newsletter. 

 

(b)        Councillor Wilcock reported that the A51 petition for a speed limit on London Road had been referred for assessment.

 

14        PUBLIC QUESTION TIME (GUIDE TIME: 10 MINUTES)

 

            There were no questions from members of the public.

APPENDIX

Amendment to Standing Order No. 15 (Minute No. 3.1 - page 964)

15A     After the first business has been completed, the order of business, unless the Council otherwise decides on the ground of urgency, shall be as follows

            a)         To consider the Minutes. If a copy of the Minutes has been provided to            each member not later than the day of issue of the summons to attend        the meeting, the Minutes may be taken as read.

b)         After consideration, to approve the signature of the Minutes by the person presiding as a correct record.

c)         To deal with questions from members of the public

            d)         To deal with business expressly required by statute to be done.

            e)         To dispose of business, if any, remaining from the last meeting.

f)          To receive such communications as the person presiding may wish to lay before the Council.

            g)         To receive and consider reports and minutes of committees.

h)         To receive and consider resolutions or recommendations in the order in which they have been notified.

j)          To consider any planning applications.

            k)         If necessary, to authorise the signing of orders for payment.

l)          To deal with questions from members of the public

            15B     Question Time Procedure

(i)                 The Parish Council shall provide an opportunity at the beginning and end of each Parish Council meeting to hear questions from members of the public.  Each session shall be of approximately 10-minutes duration.

(ii)               Any resident of the parish may submit a written question to the Clerk, at least three clear days before the meeting. A question submitted in this manner shall be considered by the Parish Council and, if the resident is not present at the meeting, a written response shall be provided by the Clerk on behalf of the Parish Council.

(iii)             As an alternative, any resident of the parish, attending a parish council meeting, can raise any issue during the period set aside for questions from members of the public.

(iv)              The Chair shall have discretion to extend the period of question time.
